How to Choose the Best Patent Attorney


If you are looking for a patent lawyer, there are many things you need to consider in order to make a well informed decision.  Here is a basic list of some considerations to test:

  • What field does this attorney or this firm specialize in?  Obviously a firm with specialization in patent or intellectual property law is ideal.  However, it is not a requirement.  Many firms are large enough to have different divisions, and employ lawyers for all sorts of purposes including personal injury, other civil lawsuits, criminal defense, and other fields.  The important thing is that the lawyer assigned to your case specializes in that field of law.  Lawyers may claim to be a “Swiss army knife”.  IP law is incredibly complex, it’s impossible for a lawyer to excel and be very knowledgeable in multiple fields like this.
  • How much experience does he have in that field?  This is where small and specialized firms usually do well.  Larger firms have a tendency to hand you off to a junior attorney that may make mistakes, or not be as efficient as they should be.  Smaller specialized firms are usually more aware and personalized in how they handle your case.  With copyright law, this can make all the difference.
  • How much care do they put into your individual case?  Our little trick for gauging this is pretty simple.  Most lawyers allow you to a book a one hour consultation for free.  Do this, and let them do most of the talking.  If they spend the hour telling you all about patent law, then they probably aren’t your best bet.  If they ask questions and explain how the law pertains to your specific case, then they look like a winner.

Aside from all of this, stick to your gut feeling.  It’s often very accurate, and helps to gauge the human element we can’t easily quantify.
